Effective date: 24 July 2025

These terms govern your use of Pyncer’s platform. Please read carefully before continuing.

Welcome to Pyncer (the ā€œServiceā€). By accessing or using the Service, you agree to these Terms of Use (the ā€œTermsā€). If you do not agree, do not access or use the Service.

1. Who we are

The Service is provided by Pyncer, registered in the United Kingdom with registered address [UK Address]. Contact us at support@pyncer.com.

2. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement.

3. Accounts & Security

  • You are responsible for safeguarding your login credentials and for any activities under your account.
  • Admins are the only users permitted to change roles (e.g., promote/demote to admin, manager, or recruiter).
  • We may (and recommend that you) enable 2FA for privileged roles (e.g., admin, manager) to enhance account security.
  • We reserve the right to suspend or terminate accounts for violations of these Terms or misuse of the Service.

4. Platform Purpose & Functionality

The Service is designed as an application tracking platform to help users (e.g., ā€œusersā€ or ā€œapplicantsā€) manage their job applications, notes, and related documents. Users may also share specific applications with recruiters or managers for a limited period (e.g., 7 days), after which access is automatically revoked unless renewed.

5. Sharing Applications

  • When you share an application, the recipient can view your data, notes, attachments, and logs for the configured duration (e.g., 7 days).
  • You are solely responsible for the content you choose to share and must ensure you have rights to share that content.
  • You can revoke access before the expiry window, where supported by the Service.

6. Prohibited Conduct

You agree not to:

  • Upload or share content that is unlawful, defamatory, infringing, or violates privacy or confidentiality obligations.
  • Attempt to circumvent security features or access data without permission.
  • Misrepresent your role, identity, or affiliation.
  • Reverse engineer, decompile, or otherwise attempt to extract source code or underlying data structures.
  • Use the Service to create a similar or competing product.

7. User Content & IP

  • You retain ownership of the content you submit to the Service.
  • By submitting content, you grant us a limited, non-exclusive, worldwide, royalty-free licence to store, display, and process the content solely for operating, improving, and providing the Service to you (and to recipients you authorise).
  • You represent and warrant that you have all necessary rights to the content you submit or share.

8. Our Intellectual Property

  • The Service, including software, design, and branding, is owned by or licensed to Pyncer and protected by intellectual property laws.
  • You may not reproduce, distribute, modify, or create derivative works from the Service without our prior written consent.

9. Disclaimers

  • The Service is provided on an ā€œAS ISā€ and ā€œAS AVAILABLEā€ basis without warranties of any kind, express or implied.
  • We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that your data will always be available or recoverable.
  • You are solely responsible for ensuring that you do not upload sensitive personal data unnecessarily (e.g., government IDs, medical data).

10. Limitation of Liability

To the maximum extent permitted by law, Pyncer and its affiliates, officers, employees, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill resulting from (a) your use of or inability to use the Service, (b) unauthorised access to or use of your data, or (c) any conduct or content of any third party on the Service.

11. Indemnification

You agree to indemnify and hold harmless Pyncer, its affiliates, and their respective officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we need to protect the Service or other users. You may stop using the Service at any time.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. You agree to the exclusive jurisdiction of the courts located in England and Wales to resolve any dispute arising from these Terms.

14. Changes to the Terms

We may update these Terms from time to time. We will post the updated Terms with a new effective date and, where appropriate, notify you by email or in-app notice. By continuing to use the Service after the update, you agree to the revised Terms.
